Under Section 12700 of the California Health and Safety Code
, any person who violates any provision of the State Fireworks Law or regulations is guilty of a misdemeanor punishable by:
- A fine not less than $500 or more than $1000
- Imprisonment in the County jail for up to one year
If a person is in possession of illegal fireworks, all fireworks will be confiscated. A person possessing or using certain types of fireworks such as an M-80, M-100, or M-1000, or using fireworks to make explosive devices may be charged with a felony.
Any property owner that allows the willful possession, sale, or discharge of illegal or dangerous fireworks shall be held responsible and is subject to a citation resulting in a fine, imprisonment, or both.
